Terms of Service

These Terms explain how OwnCRM’s website, custom CRM services, project delivery, payments, ownership structure, and use of the platform are governed.

Welcome to OwnCRM. These Terms of Service govern your access to and use of OwnCRM’s website, services, software development, CRM implementation, integrations, hosting-related setup, and related deliverables. By engaging with OwnCRM, requesting a quote, signing a proposal, or using any delivered system, you agree to these Terms.

If you do not agree with these Terms, do not use the website or engage OwnCRM’s services.


1. About OwnCRM

OwnCRM provides custom CRM design, development, implementation, deployment, workflow customization, integration setup, and related business software services for companies. Unlike subscription software products, OwnCRM may provide one-time build engagements tailored to a client’s business process.

The scope of each project may vary depending on the signed proposal, quotation, statement of work, or written agreement between OwnCRM and the client.

2. Eligibility

You may use OwnCRM’s website and services only if you are legally able to enter into a binding agreement on behalf of yourself or the business you represent.

If you are using OwnCRM on behalf of a company, organization, or employer, you confirm that you have authority to bind that entity to these Terms.

3. Scope of Services

OwnCRM may provide services including, but not limited to:

  • Custom CRM planning and consulting
  • Workflow analysis and blueprinting
  • UI and admin dashboard development
  • Role-based access setup
  • WhatsApp, Meta, IVR, IndiaMART, Justdial, payment, and third-party integrations
  • Deployment to private or approved infrastructure
  • Documentation, training, and handover
  • Ongoing enhancements, if separately agreed

All services are delivered according to the specific project scope agreed in writing. Any work outside the agreed scope may require revised pricing, updated timelines, or a separate agreement.

4. Quotes, Proposals, and Project Approval

Any quote, proposal, estimate, or project timeline shared by OwnCRM is based on the information available at the time. Final pricing, features, integrations, delivery schedule, and implementation details may depend on business requirements, technical complexity, third-party constraints, and client responsiveness.

A project begins only after written approval and any agreed advance payment is received.

5. Pricing and Payment

OwnCRM may offer one-time pricing for the build and delivery of a custom CRM system. Unless stated otherwise in a written agreement:

  • Prices are quoted in the agreed currency
  • Payment milestones may apply
  • Taxes, government duties, bank charges, or third-party service fees may be extra where applicable
  • Delayed payments may delay project delivery, deployment, support, or handover

Any third-party costs, including cloud infrastructure, domains, messaging providers, telephony vendors, payment gateways, or API usage charges, are separate unless specifically included in writing.

6. Change Requests

Custom software projects may evolve during execution. If the client requests new modules, integrations, workflows, design revisions, or changes outside the original scope, OwnCRM may treat those as change requests. Change requests may affect the project price, delivery timeline, deployment plan, and support/testing scope. No change request is considered approved unless accepted in writing.

7. Client Responsibilities

To enable timely delivery, the client agrees to:

  • provide accurate business requirements
  • nominate decision-makers and points of contact
  • share approvals, assets, content, and credentials on time
  • review deliverables within a reasonable period
  • ensure lawful use of the system and integrations
  • maintain valid licenses or access for required third-party services

OwnCRM is not responsible for delays caused by incomplete requirements, missing approvals, delayed feedback, unavailable third-party vendors, or infrastructure issues outside its control.

8. Hosting and Infrastructure

Where applicable, OwnCRM may help deploy the CRM to a private server, cloud environment, or other approved infrastructure. The client remains responsible for infrastructure costs, hosting accounts, domain ownership, SSL certificates, cloud subscriptions, and third-party services unless explicitly agreed otherwise.

OwnCRM may assist with setup, but long-term hosting performance, uptime, backups, firewall policy, and infrastructure administration may depend on the selected deployment model and support arrangement.

9. Integrations and Third-Party Services

OwnCRM may integrate with third-party platforms such as WhatsApp, Meta, telephony providers, portals, payment gateways, Google services, or custom APIs. These services are controlled by their respective providers and may change, impose limits, suspend accounts, or modify pricing and technical requirements.

OwnCRM is not responsible for outages, API changes, vendor restrictions, policy violations, account suspensions, or pricing changes imposed by third-party platforms.

10. Data and Customer Responsibility

The client is responsible for the legality, accuracy, and ownership of all data uploaded to or processed through the CRM, including contact records, employee data, documents, lead information, communication data, and other business records.

The client agrees not to use OwnCRM or any delivered system to violate laws, infringe intellectual property rights, send spam, store unlawful content, or process data without proper authority.

11. Privacy and Security

OwnCRM may implement access controls, login systems, permissions, and deployment options as part of the solution. However, the client is also responsible for appropriate internal access management, password hygiene, infrastructure administration, device security, and lawful data handling.

12. Intellectual Property

Unless otherwise stated in a signed agreement, each project’s intellectual property treatment will be governed by the commercial agreement between OwnCRM and the client. Where OwnCRM explicitly offers source code ownership or full project handover, that transfer applies only after all dues under the project are paid in full.

OwnCRM retains ownership of pre-existing tools, internal methods, general frameworks, reusable components, know-how, templates, utilities, and development practices unless explicitly assigned in writing.

13. Client Materials

The client retains ownership of the content, branding, business data, and materials provided to OwnCRM for project execution. The client grants OwnCRM a limited right to use those materials solely for the purpose of delivering the agreed services.

14. Acceptance and Delivery

A project or milestone may be considered delivered when OwnCRM provides access, demo links, staging links, code handover, deployment completion, or written notice of completion. The client is expected to review deliverables within the agreed review period.

15. Support and Post-Delivery Changes

Unless included in writing, OwnCRM is not obligated to provide unlimited post-delivery updates, maintenance, or support. Any support, enhancement, bug fixing, training extension, or new development after handover may require a separate agreement.

16. Acceptable Use

You agree not to use OwnCRM’s website, services, or delivered systems to break any law, harass users, distribute malware, attempt unauthorized access, overload systems, or scrape/copy content without permission.

17. Website Content and Marketing Material

Content on OwnCRM’s website is provided for general information and marketing purposes. Website descriptions, pricing examples, timelines, comparisons, and feature references are illustrative unless confirmed in a signed proposal.

18. Warranties Disclaimer

To the maximum extent permitted by law, OwnCRM’s website, materials, and services are provided on an “as is” and “as available” basis, except to the extent expressly stated in a written commercial agreement.

19. Limitation of Liability

To the maximum extent permitted by law, OwnCRM will not be liable for any indirect, incidental, special, consequential, exemplary, or business-interruption damages. OwnCRM’s total liability relating to a claim will be limited to the amount actually paid by the client.

20. Indemnity

You agree to indemnify and hold harmless OwnCRM, its founders, employees, contractors, and affiliates from claims, losses, liabilities, damages, and expenses arising out of your misuse of the website, data, or breach of these Terms.

21. Suspension or Termination

OwnCRM may suspend or terminate access to its website, services, environments, or support if payments are overdue, the client breaches these Terms, or technical/legal risks are identified.

22. Confidentiality

Both parties should treat confidential business, technical, and operational information shared during the project as confidential.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction specified in the applicable client agreement or, if not specified, the laws of India.

24. Changes to These Terms

OwnCRM may update these Terms from time to time. Updated versions will be posted on the website with a revised effective date.
